Sons of fishermen, these four cousins grew up frequenting the beach and enjoyed it as a place to play. However, on July 17, 2014, Ahed, Zakaria, Ismail, and Muhammad were killed on Gaza’s beach in front of Al-Deira Hotel by Israeli navy shelling. After the Israeli navy first attacked the port, the four boys began to run away, but Israel targeted them in a second strike that left them lifeless. The murder was witnessed by dozens of international journalists.

تقرير عسكري سري إسرائيلي يقر بقتل أطفال عائلة بكر بغزة

أكد التحقيق السري للنيابة العسكرية في الجيش الإسرائيلي، أن طائرة مسيرة تابعة لسلاح الجو قتلت 4 أطفال من عائلة بكر على شاطئ غزة خلال الحرب على القطاع عام 2014.

وذكر موقع “Intercept” الذي نشر يوم الأحد، نتائج التحقيق أنها تظهر كيف أدت سلسلة من الأخطاء التي ارتكبها ضباط في سلاح الجو والبحرية والاستخبارات الإسرائيلية، إلى مقتل أربعة أطفال كانوا يلعبون على الشاطئ بضربة جوية.

وتؤكد شهادة الضباط المتورطين في الهجوم ممن شملهم التحقيق، الذي تم إخفاء نتائجه من الجمهور حتى الآن أن الأطفال الأربعة قتلوا في وضح النهار على أيدي العاملين في تشغيل الطائرات المسيرة الذين قاموا عن “طريق الخطأ” بتعريف الأطفال الأربعة بأنهم مقاتلون من حركة “حماس” واستهدفوهم بصاروخين من طراز “هرماس 450”.

وكشف التحقيق أن الهجوم الذي جرى يوم الـ16 يوليو من العام 2014 أمام عشرات الصحافيين تم تنفيذه بتجاهل متهور لحياة المدنيين ودون أوامر مناسبة.

وقال مشغلو الطائرة للمحققين إنهم طلبوا بعد أن قتل الطفل الأول توضيحات من رؤسائهم بشأن طول الشاطئ الذي يستخدمه المدنيون. لكن بعد أقل من دقيقة، عندما فر الأطفال الناجون من الشاطئ، أطلق مشغلو الطائرة صاروخا ثانيا قتل ثلاثة أطفال رغم انهم لم يتلقوا إجابة عن طلبهم.

وقال أحد ضباط البحرية الذين شاركوا في الهجمات إنه تم في البداية اعتبار العملية على أنها “نجاح كبير”، معتقدين أن أربعة من مقاتلي حماس قتلوا. لكن في غضون دقائق، ذكر الصحفيون الذين كانوا في مكان قريب وشاهدوا الهجمات أن القتلى هم من الأطفال.

وقال مكتب المدعي العام بعد إغلاق التحقيق في عام 2015: “في أي مرحلة من مراحل الحادث لم تكن الشخصيات محددة على أنهم أطفال، وعليه تقرر مهاجمة الأشخاص الذين تم تحديدهم في المبنى. بعد تلقي جميع التصاريح اللازمة للهجوم وتأكيد عدم وجود مدنيين في المنطقة”.

وأدى هذا الاستهداف إلى مقتل أربعة أطفال على الفور وهم زكريا عاهد بكر (10 سنوات)، عاهد عاطف بكر (10 سنوات)، أسماعيل محمد بكر (9 سنوات) ومحمد رامز بكر (11 عاما)، كما أصيب ثلاثة آخرون بالقصف.

Fatah News Voice:
The confidential investigation of the Israeli Military Prosecution office confirmed that an Air Force drones had killed 4 children from the Bakr family on the Gaza beach during the 2014 war on the Strip.

And the website “Intercept”, which was published on Sunday, stated the results of the investigation that it showed how a series of mistakes committed by officers of the Israeli Air Force, Navy and Intelligence, killed four children who were playing on the beach with an air strike.

The testimony of the officers involved in the attack, whose investigation has been hidden from the public until now, confirms that the four children were killed in broad daylight by drones operating operators who mistakenly identified the four children as Hamas fighters and targeted them With two Hermas 450 missiles.

The investigation revealed that the attack on July 16, 2014, against dozens of journalists, was carried out with reckless disregard for the lives of civilians and without appropriate orders.

The plane’s operators told investigators that after the first child was killed, they requested clarifications from their superiors about the length of beach used by civilians. But less than a minute later, when the surviving children fled the shore, the plane’s operators fired a second missile that killed three children, although they had not received an answer to their request.

One of the Navy officers who took part in the attacks said the operation was initially considered a “great success”, believing that four Hamas fighters were killed. But within minutes, the journalists who were nearby and witnessed the attacks stated that the dead were children.

After the investigation was closed in 2015, the Public Prosecutor’s Office said: “At any stage of the incident, the figures were not identified as children, and it was therefore decided to attack the persons identified in the building. After receiving all necessary permits for the attack and confirming the absence of civilians in the area.”

This targeting resulted in the immediate killing of four children, namely Zakaria Ahed Bakr (10 years), Ahed Atef Bakr (10 years), Ismail Muhammad Bakr (9 years) and Muhammad Ramiz Bakr (11 years), and three others were wounded.

CLARIFICATION

INCORRECT NARRATIVE: “… identified the four children as Hamas fighters and targeted them With two Hermas 450 missiles.”

CORRECT NARRATIVE: The children were targeted by an Elbit Hermes 450 unmanned aerial vehicle (UAV) which fired two missiles at them.

MILITARY ADVOCATE GENERAL

The Military Advocate General (MAG Corps’) (Hebrew: הפרקליטות הצבאית‎, HaParklitut HaTzva’it) is responsible for implementing the rule of law within the Israel Defense Forces. The unit’s objectives include integrating the rule of law amongst IDF commanders and soldiers;⁸ providing commanders with the tools for the effective performance of their missions in accordance with the law; and working with the IDF achieve its goals on all legal fronts. The MAG Corps’, most noteworthly, has the ability to provide legal advice in emergencies and during warfare.[1]

The FFA Mechanism, headed by a Major General, was activated soon after the commencement of Operation ‘Protective Edge’, in the midst of the ongoing hostilities.

Decisions of the IDF MAG Military Advocate General Regarding Exceptional Incidents that Occurred During Operation ‘Protective Edge’ –

Allegations Concerning the Death of Four Children on the Gaza Strip Coast (16 July 2014) –

As previously reported, the MAG Corps received reports, as well as complaints from NGOs, wherein it was alleged that as a result of an IDF attack on 16 July 2014, four children were killed (Ahed Atef Bakr, Zakariya Ahed Bakr, Mohammad Ramiz Bakr, and Ismail Mahmoud Bakr) on the beach, adjacent to the Gaza port. Subsequently, and in accordance with the MAG’s investigation policy, the incident was referred to the FFA Mechanism for examination. The factual findings and materials collated by the FFA Mechanism, and which were presented to the MAG, indicated the existence of grounds for a reasonable suspicion that the attack was not carried out in accordance with the rules and procedures applicable to IDF forces. As a result, the MAG ordered the opening of a criminal investigation into the incident.

The MPCID investigation was recently completed, and after the MAG reviewed its findings, he decided to close the investigation file, in the absence of a suspicion regarding the commission of a criminal offence by IDF soldiers.

The investigation that was conducted was thorough and extensive. During the investigation process testimony was collected from a large number of IDF soldiers and officers who were involved in the planning and execution of the attack. Additionally, an extensive number of documents relating to the attack were reviewed, along with video footage documenting the attack in real time, as well as media images and video footage which documented parts of the incident. Moreover, MPCID investigators made efforts to collect the testimonies of Gaza Strip residents who were, allegedly, witnesses to the incident. In this context, the collection of testimony from three witnesses was coordinated. Regretfully, despite the prior coordination, the witnesses eventually declined to meet with the MPCID investigators, and instead provided affidavits in regard to the incident.

From the factual findings collected by MPCID investigators, it arose that the incident took place in an area that had long been known as a compound belonging to Hamas’s Naval Police and Naval Force (naval commandos), and which was utilized exclusively by militants. The compound in question spans the length of the breakwater of the Gaza City seashore, closed off by a fence and clearly separated from the beach serving the civilian population. It further arose in the course of the investigation (including from the affidavits provided to the MPCID by Palestinian witnesses), that the compound was known to the residents of the Gaza Strip as a compound which was used exclusively by Hamas’s Naval Police. The IDF carried out a number of attacks on the compound in the days prior to the incident. In the course of one such attack, which took place on the day prior to the incident (15 July 2014), a container located inside the compound, which was used to store military supplies, was attacked.

Decisions of the IDF MAG Military Advocate General Regarding Exceptional Incidents that Occurred During Operation ‘Protective Edge’ –

Shortly before the incident, an intelligence assessment was established which indicated that operatives from Hamas’s Naval Forces would gather in the military compound in order to prepare for military activity against the IDF. On 16 July, aerial surveillance identified a number of figures entering the compound at a running pace. These figures entered a shed adjoining the container which had been attacked the day prior. Against the backdrop of the aforementioned intelligence assessment, these were believed to be militants from Hamas’s Naval Forces, who had arrived at the compound in order to prepare to execute the aforementioned military activity against the IDF. It should be stressed that the figures were not identified at any point during the incident, as children.

In light of the above, it was decided to conduct an aerial attack against the figures which had been identified, after all the necessary authorizations for an attack had been obtained, and after a civilian presence in the area had been ruled out. When one of the identified figures entered into the remains of the container which had been attacked on the day prior to the incident, one missile was fired from the air towards the container and the adjoining shed. As a result of this attack, it appeared that one of the figures identified was hit. Following this attack, the rest of the figures began to run in the direction of the compound’s exit. Shortly before their exit from the compound, an additional missile was fired from the air towards them, which hit the figures in question after they had exited the compound. Tragically, in the wake of the incident it became clear that the outcome of the attack was the death of four children, who had entered the military compound for reasons that remain unclear. It further arose from the investigation that, under the circumstances in question, it would not have been possible for the operational entities involved to have identified these figures, via aerial surveillance, as children.

After reviewing the investigation’s findings, the MAG found that the attack process in question accorded with Israeli domestic law and international law requirements. The decision to attack was taken by the competent authorities, and the attack was aimed at figures who were understood to be militants from Hamas’s Naval Forces, who had gathered in order to prepare to carry out military activities against the IDF. At the time that the decision was made, the attack was not, according to the assessment of the operational entities, expected to result in any collateral damage to civilians or to civilian property. Moreover, the attack was carried out while undertaking several precautionary measures, which aimed to prevent any harm to civilians. Such measures included, inter alia, the choice of a munition which was not expected to cause any harm to civilians, and the deployment of real time visual surveillance. The MAG found that the professional discretion exercised by all the commanders involved in the incident had not been unreasonable under the circumstances. However, it became clear after the fact that the identification of the figures as militants from Hamas’s Naval Forces, was in error. Nonetheless, the tragic outcome of the incident does not affect the legality of the attack ex post facto.
Accordingly, the MAG ordered that the investigation file be closed without any further legal proceedings – criminal or disciplinary – to be taken against those involved in the incident. Nonetheless, inter alia as a result of this incident, the IDF has been working to improve a number of its operational capabilities, including technological capabilities, in order to
minimize the risk of the recurrence of tragic incidents of this kind.

INCIDENT SUMMARY

On July 17, 2014, Ahed, Zakaria, Ismail, and Muhammad Bakr, for unknown reasons, entered a Hamas compound that housed its Naval Police and Naval Force (Izz al-Din al-Qassam Brigades naval commandos). A fence closed off the compound from the beach area used by civilians and it was well known to the residents of the Gaza Strip as a facility used exclusively by Hamas.

The previous day, the Israeli military (IDF) had attacked the compound, targeting a container. The IDF had received intelligence information that indicated Hamas was planning an attack, utilizing the compound as a staging area, the IDF therefore, was surveilling the Hamas compound.

When Israeli aerial surveillance identified a number of figures entering the compound at a running pace, and after entering a shed adjoining the container, it was assumed that they were the Hamas terror operatives who had planned an attack against the IDF. The technology used to surveil the compound did not have the capacity to distinguish between an adult and a child. Throughout the entire incident, it was impossible to identify the figures as children.

When one of the figures entered the remains of the container which had been attacked the previous day, one missile was fired and the figure was hit. When the rest of the figures ran for the compound’s exit, a second missile was fired, hitting them just after they had exited the compound.

It was never known why the boys entered the Hamas compound. But after they did and were killed by the IDF, Martyrdom Posters of each of the four boys were printed. They contain the logo of the al-Aqsa Martyrs’ Brigades, the armed wing of Fatah, and the logo of a unit of the al-Aqsa Martyrs’ Brigades, the Abdel Qader al-Husseini Brigades.

A Martyrdom Poster is printed to commemorate a combatant killed while undertaking a mission in the name of Islam. A poster contains a picture of the martyr, and in its upper left and right corner, the logo of the terrorist organization and a picture of the founder or namesake of the terrorist organization.

THE FACTS

FACT #1: Ahed, Zakaria, Ismail, and Muhammad, one was killed in a Hamas compound and the other three were killed immediately after they exited the compound. The four boys were not killed in front of a hotel.

FACT #2: They were targeted and killed by two missiles, fired from a Hermes 450 UAV. They were not killed by a shelling.

FACT #3: The Israeli navy did not attack the port.

FACT #4: The boys did not run away from a navy attack of the port during a first attack and subsequently killed in a second strike. There was no navy attack. The first attack refers to the first missile fired by the Hermes 450 that killed the individual in the container. The second strike refers to the second missile that targeted the figures trying to escape from the Hamas compound.

FACT #5: The boys families were affiliated with Fatah and its military wing, the al-Aqsa Martyrs’ Brigades, and one of the Brigades units, the Abdel Qader al-Husseini Brigades.
