غزة – الرواسي-  نعت نقابة الصحفيين الفلسطينيين الزميل حامد شهاب ” سائق شركة ميديا 24″ للإنتاج الإعلامي الذي استشهد في قصف طائرات الاحتلال لسيارته في منطقة الرمال وسط مدينة غزة بعد مغادرته مكان عمله بوقت قصير.

وقال الصحفي احمد الفيومي في إفادة لنقابة الصحفيين ان الزميل شهاب عمل سائق في الشركة ، وقصفت سيارته بعد الانتهاء من العمل ، رغم وجود علامات الصحافة على السيارة بشكل واضح .

وأعربت نقابة الصحفيين الفلسطينيين عن بالغ الأسى لاستشهاد الزميل شهاب ، وشاطرت أسرته وأسرة شركة ميديا 24 بهذا المصاب ، محذرة قوات الاحتلال الإسرائيلي من مغبة الاستمرار في استهداف الطواقم الصحفية ، والذي يعطي مؤشر خطير أن قوات الاحتلال بدأت حربها على الصحفيين من اجل إخفاء جرائمها بحق الشعب الفلسطيني الأعزل.

وطالبت نقابة الصحفيين الفلسطينيين الاتحاد الدولي للصحفيين واتحاد الصحفيين العرب والاتحادات والنقابات العربية والدولية ، إلى المضي في إجراءاتها لمحاكمة قادة جيش الاحتلال على الجرائم التي ترتكب بحق الصحفيين في الأراضي الفلسطينية ، والتي تؤكد أن الاحتلال يتعمد استهدف الصحفيين والنيل من إرادتهم .

Journalists’ Union mourns fellow Hamed Shihab, driver of Media 24 in Gaza

Palestinian National Liberation Movement -Fatah:
Gaza – Al-Rawassi, a fellow Palestinian journalists’ union, called Hamid Chehab the driver of media production company Media 24, who was killed in the bombing of his car by Israeli aircraft in the Al-Ramal area in central Gaza City shortly after leaving his workplace.

Journalist Ahmed al-Fayoumi told the Journalists Syndicate that colleague Shihab worked as a driver in the company, and bombed his car after the work was finished, although there are clearly press marks on the car.

The Palestinian Journalists Syndicate expressed deep sorrow for the martyrdom of colleague Shihab, and shared his family and the family of Media 24 with this injured, warning the Israeli occupation forces against continuing to target the press crews, which gives a serious indication that the occupying forces began their war on journalists in order to hide Its crimes against the defenceless Palestinian people.

The Palestinian Journalists Syndicate called on the International Federation of Journalists and the Union of Arab Journalists and Arab and international unions to continue its procedures to try the leaders of the occupation army for crimes committed against journalists in the Palestinian territories, which confirm that the occupation deliberately Target journalists and undermine their will.

ANALYSIS

Shehab’s car was targeted after he left his workplace and after he finished his work for the day. Hamed Shehab was a “driver of Media 24”.

THE INCIDENT

MILITARY ADVOCATE GENERAL

The Military Advocate General (MAG Corps’) (Hebrew: הפרקליטות הצבאית‎, HaParklitut HaTzva’it) is responsible for implementing the rule of law within the Israel Defense Forces. The unit’s objectives include integrating the rule of law amongst IDF commanders and soldiers;⁸ providing commanders with the tools for the effective performance of their missions in accordance with the law; and working with the IDF achieve its goals on all legal fronts. The MAG Corps’, most noteworthly, has the ability to provide legal advice in emergencies and during warfare.[1]

The FFA Mechanism, headed by a Major General, was activated soon after the commencement of Operation ‘Protective Edge’, in the midst of the ongoing hostilities.

Allegation Concerning an Aerial Strike on a Vehicle Marked “TV” in Gaza City (9 July 2014) [published in a press release dated September 10th, 2014]-

The MAG Corps received reports, as well as correspondence from NGOs, alleging that an aerial strike was carried out in the Rimael neighborhood of Gaza City on 9 July 2014, against a vehicle marked ‘TV’, and which resulted in the death of one person alleged to be a journalist (Ahmed Abdullah Mahmoud Shahab) and in the injury of eight additional persons also alleged to be journalists. Subsequently, and in accordance with the MAG’s investigation policy, the incident was referred to the FFAM.

According to the factual findings and materials collated by the FFAM and presented to the MAG, the strike was carried out against a vehicle, which intelligence information and direct evidence (specifically, real-time aerial surveillance) indicated was being used to transport weaponry intended to be used against IDF forces or the Israeli civilian population that same day, and whose passengers were involved in the hostilities. It appears that the vehicle was marked ‘TV’ in order to mask the military use made of the vehicle to transport weaponry.
 
The MAG found that the targeting process accorded with Israeli domestic law and international law requirements. The attack was carried out against a military objective, in accordance with the requirements of the principle of proportionality, and the decision to carry out the attack was made by the authorities authorized to do so. It should be noted that, according to the factual findings, at the time of the strike the IDF forces could not discern whether the vehicle was marked ‘TV’. In any event, in light of the military use made of the vehicle for the purposes of transporting weaponry, the marking of the vehicle did not affect the lawfulness of the strike under international law. The MAG further found that the targeting process was carried out after undertaking various precautions with significant efforts to minimize the possibility of civilian harm. Such, the strike on the vehicle was at one point delayed, due to the concern that civilians in its vicinity could be harmed. Furthermore, no supporting evidence was found indicating harm caused to persons other than Shahab.
 
In light of the above, the MAG did not find that the actions of the IDF forces raised grounds for a reasonable suspicion of criminal misconduct. As a result, the MAG ordered the case to be closed, without opening a criminal investigation or ordering further action against those involved in the incident.

INCIDENT SUMMARY

Intelligence and real-time aerial surveillance demonstrated that Shehab’s vehicle was being used to transport weaponry. The fact that the vehicle was marked “TV” on its roof was irrelevant. The vehicle was being used for military purposes and it appears that the “TV” marking was used to conceal its real tasking.

The strike had absolutely nothing to do with “journalism”. The strike took place after Shehab had left his workplace and had finished all of his work for the day.

1- Based on the FFA Mechanism of the IDF MAG Corps, it can be concluded that Hamed Shehab was a combatant, engaged in the transport of military weapons.

2- Pictures of Hamed Shehab’s funeral procession indicate that he was a member of Fatah and based on his activities documented by the IDF MAG Corps, it can be concluded that he was a Fatah terror operative.

3- The Guardian article and Twitter posts suggest that Hamed Shehab was never a journalist and that he worked for Media 24 as a driver – he was or had been a taxi driver.

Hamed Shehab was not a journalist. He was a driver for Media 24, was or had been a taxi driver. Media 24 is a South Africa-based news organization, NOT a Gaza-based news website. Missing from the original Humanize Palestine website’s narrative was the fact that Shehab was using his Media 24 vehicle to transport weaponry to use against the IDF and/or Israeli civilians. Shehab was clearly involved in the hostilities of the 2014 Gaza war.
