On Saturday, July 19, 2014, Israeli airstrikes and indiscriminate bombings hit the home of the Elzowidi family, in Beit Hanoun, north of the Gaza Strip, and killed five members of the Elzowidi family:

- Dalia Abdel Hamid Elzowidi, 37 years old

Abir Elzowidi, a cousin of the Elzowidi painfully describes the Elzowidi family’s final moments:
“A few days ago, five members of my family—including two small children 2 and 6 years old—were killed in their homes in that village of Beit Hanoun in Gaza, while baking their bread for the day wishing to share it together praying to God to spend one more day with each other while they watching Israel randomly bombing neighbors. Israel give them what they wished for! But sadly dead and buried next to each other. One child, a five-year old boy with special needs, lies injured in the hospital and has been left orphaned. The bread that they baked left soaking wet in their blood and my family kept picking up the hair and scalp and the little bodies of the two girls that was found in pieces. Now several other family members have been forced to leave their homes, and others watched their homes destroyed with this evil bombs and are homeless for the second time in their life after the 1948 “Nakba,” including my 2 grandmother Fatimah, 93 year-old and Aisha 84 years old. Why [do] they do this? What crime did my people commit for Israel to kill them?”

During the era of the martyrs going forward, with the soldiers of our victorious brigade, we will crush the occupier and shake its corners, for our heroic martyrs a thousand peace, for those who sacrificed their lives and redeemed Palestine with their pure blood, for our revolutionary Palestinian people saluting as he lays the highest verses of the championship and presents the martyr reciting the martyr to go on the era of our loyal leaders. A great struggle, stride with their blood to salute dignity.
And to commemorate the heroic martyrs, a delegation from the Al-Aqsa Martyrs Brigades – Palestine, “The Martyr Nidal Al-Amoudi Brigade,” visited a house of the martyrs of the “Al-Zuwaidi” family.
Brother Abu Muhammad began his speech with the word Al-Aqsa Brigades, saying, “Mercy to the righteous martyrs who established for us with their pure blood a glorious ancient revolution that is marching on its free path, glory kneeling to the martyrs of our glorious people.”
The visit ended with the martyrs ‘family receiving a symbolic image, as an expression of the loyalty of the Brigades to the martyrs of its people and heroes’ movement.

The Military Advocate General (MAG Corps’) (Hebrew: הפרקליטות הצבאית, HaParklitut HaTzva’it) is responsible for implementing the rule of law within the Israel Defense Forces. The unit’s objectives include integrating the rule of law amongst IDF commanders and soldiers;⁸ providing commanders with the tools for the effective performance of their missions in accordance with the law; and working with the IDF achieve its goals on all legal fronts. The MAG Corps’, most noteworthly, has the ability to provide legal advice in emergencies and during warfare.[1]

FFA MECHANISM
A General Staff Mechanism for Fact-Finding Assessments (the ‘FFA Mechanism’) examines Exceptional Incidents that occurred during Operation ‘Protective Edge’. The FFA Mechanism, headed by a Major General, was activated soon after the commencement of Operation ‘Protective Edge’, in the midst of the ongoing hostilities.

Allegations Concerning the Deaths of Five Persons as a Result of a Strike on a Building in Beit Hanoun (19 July 2014)
In an NGO publication, as well as in a report and complaint received by the MAG Corps from NGOs, it was alleged that on 19 July 2014, at around 10:30, five members of the a-Zwiedi family were killed as a result of an IDF ground attack on a building in Beit Hanoun. According to the complaint, the a-Zwiedi house was hit by a shell that was fired at a fourth-floor apartment in the family’s home. The incident was subsequently referred to the FFA Mechanism for examination.
According to the factual findings collated by the FFA Mechanism and presented to the MAG, IDF forces were engaged in extensive combat operations against numerous enemy forces operating in the area in which the a-Zwiedi house was located. The IDF’s ground operations in the area began on 18 July 2014 – one day prior to the alleged attack, after efforts had been made to clear the area of civilians. Nevertheless, a comprehensive examination determined that IDF forces did not direct any aerial or ground attack towards the house around the time of the alleged attack. In the course of the examination, at the FFA Mechanism’s request, it received additional materials and information from the representative of the NGO that submitted the complaint to the MAG Corps, including images of the damaged building. These additional materials did not give rise to any change in the FFA Mechanism’s assessment with respect to the incident.
After reviewing the factual findings and the material collated by the FFA Mechanism, according to which no IDF attack on the building was identified, the MAG instructed to continue the factual assessment through a preliminary investigation by the Criminal Investigative Unit for Operational Affairs (the ‘CIUO’) of the IDF Military Police.
In the course of the CIUO investigation, testimony was collected from the owner of the apartment who allegedly was present on the floor of the building that was targeted at the time of the attack, and whose wife was allegedly killed in the incident. Testimony was also collected from various professionals and from the operational entities involved in the hostilities in the area. Moreover, the IDF’s relevant systems were analyzed alongside additional documentation, together with the materials that were provided by the representative of the NGO that submitted the complaint.
The factual findings that were collated by the FFA Mechanism and the CIUO and presented to the MAG indicate that IDF forces did not conduct any aerial or ground strike against the house specified in the complaint and reports. Furthermore, according to the testimony of the professionals who analyzed the images submitted by the representative of the complainant and other sources of information, the damage caused to the house did not conform with the type of damage that could be caused by munitions that were in use by IDF forces. The professionals also testified that it was not possible to determine with certainty what kind of munition hit the house, nor its source. It was further determined that two of the alleged civilian casualties in the incident were military operatives in terrorist organizations operating in the Gaza Strip.
After reviewing the factual findings and the material collated by the FFA Mechanism and the CIUO, the MAG found that there was no basis to the allegation that members of the a-Zwiedi family were harmed as a result of a direct attack by IDF forces aimed at the family’s home. The MAG further found that, in the event that the damage to the structure was caused as an indirect result of IDF operations in the area, such damage would have been the regrettable result of the active hostilities, which the operational authorities could not have foreseen prior to its occurrence. As a result, and as there were no reasonable grounds for suspicion of criminal misconduct, the MAG ordered the case to be closed, without opening a criminal investigation.
INCIDENT SUMMARY
On July 19, 2014, Israeli military forces were engaged in extensive combat operations against Palestinian forces operating in the area in which the al-Zweidi family house was located. Five members of the al-Zweidi family were killed when their building was hit by some type of ordinance. The following facts were revealed after an investigation was conducted by the IDF MAG Corps:
1- The Israeli military did not direct any aerial or ground attack towards the house during the time of the alleged attack.
2- No IDF attack on the building was identified.
3- The damage caused to the house did not conform with the type of damage that could be caused by munitions that were in use by IDF forces.
4- Two of the casualties in the incident were military operatives.
